Terms of Use for ImanUp

Welcome to ImanUp. These Terms of Use ("Terms") govern your access to and use of the ImanUp mobile application and related services (collectively, the "App"). By downloading, accessing, or using ImanUp, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Use of the App and Account Registration

To use certain features of ImanUp, you may be required to create an account. You agree to provide accurate, current, and complete information and to keep your account credentials secure. You are responsible for all activities that occur under your account. You agree to use the App responsibly, respectfully, and in compliance with all applicable local, state, and national laws.

2. User Content

You retain ownership of the content, messages, or materials you post, submit, or display on ImanUp ("User Content"). By posting User Content, you grant ImanUp a non-exclusive, worldwide, royalty-free license to use, store, and display your content to operate and improve the App.

You are solely responsible for your User Content. We reserve the right (but have no obligation) to review, monitor, or remove User Content at our sole discretion, without notice, particularly if it violates these Terms or our Community Guidelines.

3. Community Guidelines

ImanUp is designed to be a respectful and supportive environment. When using the App, you agree not to:

• Harass, bully, threaten, or discriminate against other users.
• Post or share content that is harmful, offensive, hateful, or explicit.
• Spread false, misleading, or malicious information.
• Abuse, spam, or disrupt religious discussions and community spaces.
• Engage in any activity that interferes with the proper functioning of the App.

4. AI Assistant and Religious Content Disclaimer

ImanUp features an AI-powered assistant designed to provide general information and facilitate learning. You acknowledge and agree to the following regarding the AI assistant:

• No Religious Rulings: The AI assistant does not provide authoritative religious rulings, edicts, or fatwas.
• Accuracy: While we strive for quality, AI-generated responses may be inaccurate, incomplete, or lack necessary context.
• Not Authoritative Guidance: You agree not to rely on the AI assistant as a substitute for professional religious scholars, authoritative texts, or qualified human guidance. Your reliance on any information provided by the AI is strictly at your own risk.

5. Subscriptions and Billing

ImanUp may offer premium features via auto-renewing subscriptions.

• Billing: All payments, billing, and subscription management are handled directly by the platform provider (Apple App Store or Google Play Store).
• Auto-Renewal: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• Refunds: Because payments are processed by Apple or Google, all refund requests must be directed to and managed by their respective support systems according to their policies. ImanUp cannot directly issue refunds.

6. Intellectual Property

All rights, title, and interest in and to the App, including its original content, features, branding, logos, and underlying technology, are and will remain the exclusive property of ImanUp and its licensors. You may not copy, modify, distribute, sell, lease, or reverse-engineer any part of our App without our explicit written consent.

7. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IMANUP DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM HARMFUL COMPONENTS.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL IMANUP, ITS CREATORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING FROM:

• Your use of or inability to use the App.
• Any conduct or content of any third party or user on the App.
• Any content or advice generated by the AI assistant.
• Unauthorized access, use, or alteration of your transmissions or content.

9. Indemnification

You agree to indemnify, defend, and hold harmless ImanUp and its affiliates from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your User Content.

10. Termination

We reserve the right to suspend or terminate your account and access to the App at our sole discretion, at any time, and without notice or liability, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the App will immediately cease, and your data may be deleted or retained as required by law.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Binding Arbitration and Class Action Waiver: Any dispute arising out of or relating to these Terms or the App shall be resolved through binding arbitration in Texas, rather than in court. You agree to waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms will otherwise remain in full force and effect and enforceable.

13. Changes to Terms

We reserve the right to modify or replace these Terms at any time. We will provide notice of any material changes by updating the "Effective Date" at the top of these Terms or through an in-app notification. Your continued use of the App following any changes constitutes acceptance of the new Terms.
